Planning Appeal Inquiry

Following up on our Post of the 9th May , we have looked further into the documentation on the Broxtowe Planning Portal.

1. The crux of the Appeal seems to be that Broxtowe Borough Council’s failure “to give notice of its decision due to a lack of engagement from Highways Consultees, the Inspector will need to consider highways matters”. Reading further, the Consultees have asked for a “wider transport modelling exercise for the wider allocation as the justification for their stance, the reasonableness of which will be the subject to debate at the appeal”. As you will be aware from our previous representations on all the Toton planning applications submitted to date by Bloor Homes, The Forum supports such a holistic approach and not just for transport

2. It is unclear whether other submissions have been considered or will be considered at the Appeal, or whether it will focus entirely upon the traffic modelling and the appropriateness of the proposed junction. In the Forum’s opinion, the appeal should consider all outstanding issues surrounding the application where there is disagreement, not just transport, as important as that is.

3. The documentation includes both a Statement of Case from Bloor and a Statement of common/uncommon ground between Broxtowe Borough Council and Bloor Homes Ltd. However, Broxtowe as the Local Planning Authority (LPA) have yet to submit their own Statement of Case, nor agree/disagree to the common ground statement as written by Bloor.

The Forum will submit its own statement to the inquiry.

4. It is for you as individuals to decide whether you wish to make a submission and/or take part in the appeal, and the letter of the 8th May referred to in our previous post gives details as to how to do that.

5) If you wish to comment (and we would encourage you to do so independently), make any additional comments or withdraw any representations you made on the application, you must make this request to the Planning Inspectorate by 5 June 2026. You can do this online at https://appeal-planning-decision.service.gov.uk/comment-planning-appeal/appeals/6006412 (which is slightly different to that given in the letter).

6. To reiterate, if you have previously made representations to 25/00371/OUT, then there is no need to repeat them as they will be taken into account by the Inspector. However, if you wish to make any new comments on the application or the appeal, then please do so as above, bearing in mind “All written submissions from the application stages will be taken into account by the inspector and re-stating the same points won’t add any additional weight”, as stated in the appeal notification letter.

7. The Inquiry will open at 10am on Tuesday 25 August and will be held at the Council Offices on Foster Avenue. It is expected that the Inquiry will last for 6 days.
